生成式人工智能與版權

    近年來發生多起因生成式人工智能(可生成文本、圖像、視頻、影音)而衍生的版權爭議,包含受版權保護的作品來訓練生成式人工智能軟件、生成式人工智能的生成物的版權、使用生成式人工智能生成物的潛在侵權責任、以及模仿人類藝術家身分的或風格的生成物的處理。

 

    美國版權局爲了瞭解現行生成式人工智能技術發展,以及生成式人工智能技術對于各行業及版權人所造成的影響,于今年舉行4場公開聽證會由藝術創作者、學術專家、法律人員、科技公司、産業協會及版權局將近90位參與人分享各自的觀點;幷舉行網絡研討會召集世界各地的專家,討論生成式人工智能和版權法的國際發展;以及參與各領域團體各自舉行的數十次會議,美國版權局聽取各方意見,以評估是否有立法或監管措施的必要。

 

    美國版權局于今年8月30日展開公開意見徵詢活動,在今年10月底初步書面意見徵詢結束前,美國版權局已收到將近1萬份的書面意見,而回復意見徵詢預計在今年12月6日結束。

On Generative Artificial Intelligence and Copyright

   In recent years, a multitude of copyright disputes have arisen due to generative artificial intelligence (“AI”) (capable of producing text, images, video and audio outputs). These disputes include disputes surrounding the use of copyrighted works to train generative AI models, the copyrightability of works created using generative AIs, the potential infringement liability associated with producing works through generative AIs, and the treatment of AI-generated outputs that emulate the identity or style of human artists.

 

  To gain deeper insights into the recent advancements in generative AI technology and its impact on various industries and copyright holders, the U.S. Copyright Office held four public hearings this year, which brought together close to ninety artists, academic experts, legal professionals, technology companies, industry associations and copyright offices, and provided them with a valuable opportunity to share their views on these matters. The U.S. Copyright Office also organized webinars gathering experts from all over the world to discuss the international developments in generative AIs and copyright law. Additionally, the U.S. Copyright Office participated in several meetings hosted by diverse organizations representing different sectors to collect additional insights and assess whether legislative or regulatory actions are warranted in the current context.

 

  The U.S. Copyright Office launched a public consultation campaign on August 30 this year, set to conclude on December 6. By the end of October, the office had already received nearly ten thousand written comments.
